There has been an exciting new development for homeowners with parcels that were previously limited by power lines at the rear of their property. As of June 1, 2019 the LADWP will now allow for one-story new construction or garage-conversion Accessory Dwelling Units (ADUs) to be approved beneath the 'drip-lines' of power poles, in most cases. A two-story ADU is also possible, but an applicant must demonstrate that the design will sit fully outbound of various sectional easement projections. If the proposed ADU is within 10'-0" of a Public Utility Easement, a PUE Encroachment Permit will still be required but with proper documentation (Site Plan, Building Elevations, and Lot Survey) this process can be expedited to 2-3 months and there is no LADWP fee for filing the application. Two bills (AB-68 and AB-881) were recently passed by the California State Senate and Assembly on September 13, 2019. Local agencies such as the LADBS may no longer require the replacement of any existing parking stalls, which are displaced through the demolition or conversion of an existing garage into an ADU. This means you can continue to use your entire yard for outdoor enjoyment, rather than paving 400 SF for parking.
